As a high-risk disabled Californian staying at home in San Francisco, I am not jealous that people are enjoying bars, beaches, and parks. I am angry seeing so many people outdoors not wearing masks or social distancing. As various cities and states begin to ease their <\/span><a href=\"https:\/\/www.pbs.org\/newshour\/show\/on-memorial-day-lifting-of-pandemic-restrictions-brings-both-relief-and-concern\"><span style=\"font-weight: 400;\">shelter-in-place restrictions<\/span><\/a><span style=\"font-weight: 400;\">, I fear for the millions who will be left behind.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The public is incredibly eager to get back to \u201cnormal\u201d as thousands of people continue to die in congregant settings and institutions such as nursing homes, <\/span><a href=\"https:\/\/www.ndrn.org\/resource\/immigrants-with-disabilities-at-risk-for-covid-19-in-detention-centers\/\"><span style=\"font-weight: 400;\">detention centers<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.npr.org\/sections\/coronavirus-live-updates\/2020\/04\/20\/838943211\/73-of-inmates-at-an-ohio-prison-test-positive-for-coronavirus\"><span style=\"font-weight: 400;\">prisons<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/2020\/apr\/15\/san-francisco-homeless-coronavirus-msc-shelter\"><span style=\"font-weight: 400;\">shelters<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/www.nbcnews.com\/health\/mental-health\/coronavirus-psychiatric-hospital-it-s-worst-all-worlds-n1184266\"><span style=\"font-weight: 400;\">psychiatric<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.witf.org\/2020\/04\/02\/no-visitor-coronavirus-policies-separate-kids-in-residential-treatment-from-families\/\"><span style=\"font-weight: 400;\">residential<\/span><\/a><span style=\"font-weight: 400;\">, and other long-term care facilities, out of sight, out of mind. I am perplexed by the lack of urgency in response to people trapped in institutions and congregate settings who face maximum risks with minimal protections. Many are my disabled kin<\/span><span style=\"font-weight: 400;\">\u2060\u2014<\/span><span style=\"font-weight: 400;\">they are part of the disability community segregated and isolated in the name of \u201csafety\u201d and \u201ccare.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of the first widely-publicized COVID-19 outbreaks happened at a nursing home in Kirkland, WA, with <\/span><a href=\"https:\/\/www.seattletimes.com\/seattle-news\/times-watchdog\/coronavirus-spread-in-a-kirkland-nursing-home-for-weeks-while-response-stalled\/#timeline\"><span style=\"font-weight: 400;\">142 cases and 35 deaths<\/span><\/a><span style=\"font-weight: 400;\"> from February to March. As of June 4, over 43,725 people in long-term care facilities died from COVID-19 in 40 states, with New York reporting the highest number: 6,237 according to the <\/span><a href=\"https:\/\/www.kff.org\/health-costs\/issue-brief\/state-data-and-policy-actions-to-address-coronavirus\/\"><span style=\"font-weight: 400;\">Kaiser Family Foundation<\/span><\/a><span style=\"font-weight: 400;\">. All of these numbers come with names, faces, and families, not just body bags. What number will be high enough for people to care? This is a complete political and moral failure.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The federal government is considering rolling back <\/span><a href=\"https:\/\/www.usatoday.com\/story\/news\/investigations\/2020\/05\/04\/coronavirus-nursing-homes-feds-consider-relaxing-infection-control\/3070288001\/\"><span style=\"font-weight: 400;\">infection control requirements<\/span><\/a><span style=\"font-weight: 400;\"> in nursing homes, <\/span><span style=\"font-weight: 400;\">which <\/span><a href=\"https:\/\/www.cdc.gov\/infectioncontrol\/basics\/standard-precautions.html\"><span style=\"font-weight: 400;\">prevent or stop<\/span><\/a><span style=\"font-weight: 400;\"> the spread of <\/span><span style=\"font-weight: 400;\">infections<\/span><span style=\"font-weight: 400;\"> with procedures such as having standard practices on hygiene and handling equipment. A 2017 analysis of nursing home data by the <\/span><a href=\"https:\/\/www.kff.org\/coronavirus-covid-19\/issue-brief\/covid-19-and-workers-at-risk-examining-the-long-term-care-workforce\/\"><span style=\"font-weight: 400;\">Kaiser Family Foundation<\/span><\/a><span style=\"font-weight: 400;\"> reported <\/span><span style=\"font-weight: 400;\">at least 40 percent of the nursing homes had at least one infection control deficiency that year.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At least 18 states have laws or governor\u2019s orders that <\/span><a href=\"https:\/\/time.com\/5835228\/nursing-homes-legal-immunity-coronavirus\/\"><span style=\"font-weight: 400;\">protect nursing homes<\/span><\/a><span style=\"font-weight: 400;\"> from lawsuits and\/or criminal prosecution related to the pandemic. <\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/2020\/may\/26\/andrew-cuomo-nursing-home-execs-immunity\"><span style=\"font-weight: 400;\">New York and New Jersey<\/span><\/a><span style=\"font-weight: 400;\"> so far are the only two states to provide immunity to corporate officials from the nursing home industry from civil lawsuits and some forms of criminal prosecution. Governor Gavin Newsom <a href=\"https:\/\/www.scribd.com\/document\/459364242\/Liability-Protection-Coalition-Letter-Final-2#from_embed\">received a request in April<\/a> from a group of hospital and assisted living lobbyists for a sweeping Executive Order granting broad immunity from civil and criminal liability objected by <a href=\"https:\/\/missionlocal.org\/2020\/05\/disabled-people-advocates-urge-gov-newsom-to-spurn-hospital-and-nursing-home-request-for-covid-19-legal-immunity\/\">advocates from the disability community<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Governors need to launch investigations into outbreaks at all congregate settings, mandate reporting of infections and deaths, enact <\/span><a href=\"https:\/\/www.npr.org\/sections\/coronavirus-live-updates\/2020\/05\/15\/857279265\/as-nursing-homes-report-more-covid-19-deaths-more-governors-order-universal-test\"><span style=\"font-weight: 400;\">universal testing<\/span><\/a><span style=\"font-weight: 400;\"> for all workers and residents, provide adequate personal protective equipment, increase wages and protections for workers, and <\/span><a href=\"https:\/\/www.kqed.org\/science\/1963939\/california-assisted-living-nursing-home-caregivers-want-immunity-from-legal-claims\"><span style=\"font-weight: 400;\">deny the nursing home industry<\/span><\/a><span style=\"font-weight: 400;\"> the legal immunity it is demanding. In <\/span><a href=\"https:\/\/www.youtube.com\/watch?v=Oy3WgvCZEjg&amp;t=3s\"><span style=\"font-weight: 400;\">a May 6, 2020 video<\/span><\/a><span style=\"font-weight: 400;\"> featuring the late <\/span><a href=\"https:\/\/disabilityvisibilityproject.com\/2020\/05\/23\/staceytaughtus-syllabus-work-by-stacey-milbern-park\/\"><span style=\"font-weight: 400;\">Stacey Park Milbern<\/span><\/a><span style=\"font-weight: 400;\">, a disabled activist and a founder of the <\/span><a href=\"https:\/\/www.kqed.org\/news\/11806414\/coronavirus-how-these-disabled-activists-are-taking-matters-into-their-own-sanitized-hands?fbclid=IwAR3UQ9t-hvigcQmjNap2oGS3sXNh_8GYC1mASvj1PhmFLKZn0AcBmVuuNDY\"><span style=\"font-weight: 400;\">Disability Justice Culture Club<\/span><\/a><span style=\"font-weight: 400;\">, she warned:\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">There has to be checks and balances on hospitals and nursing homes. Otherwise, disabled people, especially people of color, are left alone in a system that already doesn\u2019t care about us.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Congregant settings <\/span><a href=\"https:\/\/www.gao.gov\/products\/GAO-20-576R\"><span style=\"font-weight: 400;\">do not ensure safety or care<\/span><\/a><span style=\"font-weight: 400;\">. By design, institutions do not allow us to know about the conditions of the people incarcerated inside. They are allowed to operate <\/span><a href=\"https:\/\/www.propublica.org\/article\/a-quarter-of-the-residents-at-this-nursing-home-died-from-covid-19-families-want-answers\"><span style=\"font-weight: 400;\">without transparency<\/span><\/a><span style=\"font-weight: 400;\"> and accountability. They render people as <\/span><a href=\"https:\/\/www.latimes.com\/california\/story\/2020-05-03\/coronavirus-nursing-homes-financial-profits\"><span style=\"font-weight: 400;\">less than human<\/span><\/a><span style=\"font-weight: 400;\">, subject to <\/span><a href=\"https:\/\/khn.org\/news\/covid-plagued-california-nursing-homes-often-had-problems-in-past\/\"><span style=\"font-weight: 400;\">exploitation, abuse, and neglect<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">This is where community-based services come in. We must dismantle the nursing home industry that places <\/span><a href=\"https:\/\/dredf.org\/2020\/05\/06\/joint-letter-opposing-health-care-providers-request-for-complete-immunity-from-responsibility-for-negligent-health-care\/\"><span style=\"font-weight: 400;\">profits over lives<\/span><\/a><span style=\"font-weight: 400;\"> as they endanger their workers and operates with inadequate oversight and regulation. And we must work toward <\/span><a href=\"https:\/\/www.democracynow.org\/2020\/5\/5\/ruth_wilson_gilmore_abolition_coronavirus\"><span style=\"font-weight: 400;\">decarceration<\/span><\/a><span style=\"font-weight: 400;\"> and deinstitutionalization because these systems are dangerous, inhumane, and unjust.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Disabled people for decades fought for the rights to live in the community. The 30th anniversary of the <\/span><a href=\"https:\/\/www.ada.gov\/ada_intro.htm\"><span style=\"font-weight: 400;\">Americans with Disabilities Act (ADA)<\/span><\/a><span style=\"font-weight: 400;\"> will take place this July and I think about how different my life would have been without it and the <\/span><a href=\"https:\/\/www.olmsteadrights.org\/about-olmstead\/\"><span style=\"font-weight: 400;\">Olmstead decision<\/span><\/a><span style=\"font-weight: 400;\">, a Supreme Court ruling in 1999 that stated people with disabilities have the right to receive state-funded services in the community instead of an institution. Despite these advancements in civil rights, <\/span><a href=\"https:\/\/www.cbpp.org\/blog\/more-federal-medicaid-funding-needed-to-protect-home-and-community-based-services\"><span style=\"font-weight: 400;\">the struggle continues<\/span><\/a><span style=\"font-weight: 400;\"> as there is an <\/span><a href=\"https:\/\/www.kff.org\/medicaid\/report\/medicaid-and-long-term-services-and-supports-a-primer\/\"><span style=\"font-weight: 400;\">institutional bias in Medicaid<\/span><\/a><span style=\"font-weight: 400;\"> funding and <\/span><a href=\"https:\/\/www.kff.org\/medicaid\/issue-brief\/key-questions-about-medicaid-home-and-community-based-services-waiver-waiting-lists\/\"><span style=\"font-weight: 400;\">significant waiting lists<\/span><\/a><span style=\"font-weight: 400;\"> for community-based services across states.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Disability rights are civil, labor, and human rights. <\/span><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\">We need to advocate for an increase in Medicaid funding of <\/span><a href=\"https:\/\/heller.brandeis.edu\/community-living-policy\/images\/pdfpublications\/2020aprcaseydingell.pdf\"><span style=\"font-weight: 400;\">home and community-based services<\/span><\/a><span style=\"font-weight: 400;\"> by supporting future pandemic relief proposals and bills such as the <\/span><a href=\"https:\/\/www.aging.senate.gov\/imo\/media\/doc\/Seniors%20and%20PWD%20COVID%2019%20Relief%20Act%20OnePager%202.1.pdf\"><span style=\"font-weight: 400;\">Coronavirus Relief for Seniors and People with Disabilities Act<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">We should urge our representatives in Congress to extend the <\/span><a href=\"https:\/\/medicaid.publicrep.org\/feature\/money-follows-the-person\/\"><span style=\"font-weight: 400;\">Money Follows the Person<\/span><\/a><span style=\"font-weight: 400;\"> demonstration program which helps states transition people out of nursing homes into the community. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">We also have to support policies at the state and federal level that raise the wages, benefits, and protections for <\/span><a href=\"https:\/\/www.domesticworkers.org\/\"><span style=\"font-weight: 400;\">domestic and home care workers<\/span><\/a><span style=\"font-weight: 400;\"> who are predominantly women of color.\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Safety is an illusion and privilege for the very few. Knowing that <\/span><a href=\"https:\/\/www.npr.org\/sections\/goatsandsoda\/2020\/04\/13\/831883560\/can-a-coronavirus-patient-who-isnt-showing-symptoms-infect-others\"><span style=\"font-weight: 400;\">asymptomatic carriers<\/span><\/a><span style=\"font-weight: 400;\"> are out in public, the time it takes to <\/span><a href=\"https:\/\/www.statnews.com\/2020\/05\/06\/mounting-promises-on-covid-vaccines\/\"><span style=\"font-weight: 400;\">develop a vaccine<\/span><\/a><span style=\"font-weight: 400;\"> or treatment, and possible <\/span><a href=\"https:\/\/www.latimes.com\/california\/story\/2020-05-05\/mutant-coronavirus-has-emerged-more-contagious-than-original\"><span style=\"font-weight: 400;\">changes in the virus<\/span><\/a><span style=\"font-weight: 400;\">, I will remain at home long after any orders are lifted because <\/span><a href=\"https:\/\/www.vox.com\/first-person\/2020\/4\/4\/21204261\/coronavirus-covid-19-disabled-people-disabilities-triage\"><span style=\"font-weight: 400;\">I simply do not feel safe.<\/span><\/a><span style=\"font-weight: 400;\"> I am deeply concerned about the resurgence of institutions as the \u201cbest and only\u201d option for people with significant medical and care needs, including those who have survived COVID-19 or continue to <\/span><a href=\"https:\/\/www.theatlantic.com\/health\/archive\/2020\/06\/covid-19-coronavirus-longterm-symptoms-months\/612679\/\"><span style=\"font-weight: 400;\">experience long-term symptoms<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As a disabled woman of color, my life is unavoidably high-risk. <\/span><a href=\"https:\/\/www.kqed.org\/news\/11819583\/no-one-is-disposable-living-with-disability-during-a-pandemic?fbclid=IwAR254VOo1BWaQJFyyw6d3FwjXO5XzQu7dMPePH4L-emUazfM7CaFAUxsUk4\"><span style=\"font-weight: 400;\">I fight to be seen<\/span><\/a><span style=\"font-weight: 400;\"> while knowing I\u2019m one infection, medical crisis, or policy change away from institutionalization or death. This pandemic lifted the veil on what kinds of people are considered <\/span><a href=\"https:\/\/www.cnn.com\/2020\/05\/04\/politics\/chris-christie-coronavirus-deaths-reopening\/index.html?utm_source=twCNNp&amp;utm_medium=social&amp;utm_content=2020-05-04T23%3A46%3A05&amp;utm_term=image\"><span style=\"font-weight: 400;\">\u201cacceptable losses\u201d<\/span><\/a><span style=\"font-weight: 400;\"> in the name of saving the economy: <\/span><a href=\"https:\/\/www.ghlf.org\/black-people-dying-covid-19-america\/\"><span style=\"font-weight: 400;\">Black<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.nytimes.com\/2020\/05\/07\/us\/coronavirus-latinos-disparity.html\"><span style=\"font-weight: 400;\">brown<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/truthout.org\/articles\/im-native-and-disabled-the-government-is-sacrificing-my-people\/\"><span style=\"font-weight: 400;\">indigenous<\/span><\/a><span style=\"font-weight: 400;\">, poor, <\/span><a href=\"https:\/\/time.com\/5826098\/coronavirus-people-with-disabilities\/\"><span style=\"font-weight: 400;\">disabled<\/span><\/a><span style=\"font-weight: 400;\">, older, fat, <\/span><a href=\"https:\/\/creakyjoints.org\/advocacy\/open-at-my-high-risk-hashtag\/\"><span style=\"font-weight: 400;\">chronically ill, and immunocompromised people<\/span><\/a><span style=\"font-weight: 400;\"> just to name a few. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Right now Black people are risking their lives protesting against systemic racism in the face of both the virus and state violence. Fighting for justice and liberation requires the abolition of all systems that oppress and punish us for merely existing.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/nobodyisdisposable.org\/\"><span style=\"font-weight: 400;\">No one is disposable<\/span><\/a><span style=\"font-weight: 400;\"> or invisible. We can\u2019t look away from these deaths while enjoying the sun and sand. By the 60th anniversary of the ADA I want to see older and disabled people fully integrated into the community with robust supports and services.
